Much of the case is focused on allegations Mr Trump's real estate and business holdings violate a little-known emoluments clause of the constitution.

Trump has broken many promises to keep separate his public duties and private business interests, according to the two, citing Eric Trump's remarks that his father would continue to receive regular updates about his company's financial health in the White House. Just days after Trump's inauguration in January, the government watchdog Citizens for Responsibility and Ethics in Washington filed a federal lawsuit in the Southern District of NY.

Payments to Trump's hotels do not qualify as a violation of the emoluments clause, which is meant to cover personal services performed by the president, the government said.

Legal scholars who have addressed the emoluments clauses as they pertain to President Trump have mixed opinions.
